Introduction

These Terms & Conditions apply to all dance classes, workshops, choreography, rehearsals, filming, showreel production, social media content creation, editing and other creative services provided by In2Frame ("In2Frame", "we", "us" or "our").

By booking, purchasing or participating in an In2Frame service, you ("the Client", "you" or "your") agree to these Terms & Conditions.

Where a participant is under 18, these Terms & Conditions must be accepted by their parent or legal guardian.

1. Our Services

In2Frame provides creative services which may include:

  • Dance classes and training
  • Dance workshops
  • Choreography
  • Private or group tuition
  • Rehearsals
  • Showreel creation
  • Dance filming
  • Photography and video content
  • Video editing
  • Social media reels and other promotional content
  • Creative direction
  • Other agreed creative services.

The exact services, dates, times, locations, deliverables and prices will be confirmed at the time of booking.

2. Bookings

A booking is confirmed once:

  • In2Frame has accepted the booking; and
  • Any required payment or deposit has been received.

Availability is not guaranteed until the booking has been confirmed.

For bespoke creative projects, In2Frame may require a deposit or full payment before work begins.

For group classes or workshops, a place may not be held unless payment has been received.

3. Prices and Payment

All prices will be communicated to the Client before booking.

Payment must be made using the payment method specified by In2Frame.

Unless otherwise agreed:

  • Class and workshop fees must be paid in advance.
  • Deposits are required for certain private or bespoke bookings.
  • Creative production work may require a deposit before filming or editing begins.
  • The remaining balance must be paid by the agreed deadline.

In2Frame reserves the right not to commence or deliver services where required payment has not been received.

Where payment is overdue, In2Frame may suspend the relevant service until payment is received.

4. Deposits

Where a deposit is required, the amount and payment deadline will be communicated before the booking is confirmed.

The deposit secures the agreed date, time and/or services and may be used to cover preparation, administration, studio bookings, equipment, staffing and other costs incurred by In2Frame.

Where the Client cancels a bespoke booking, the deposit may be retained to cover costs and losses incurred by In2Frame, subject to the Client's statutory rights.

5. Cancellations by the Client

Classes and workshops

If you are unable to attend a class or workshop, you should notify In2Frame as soon as possible. Unless otherwise stated at the time of booking, missed classes are generally non-refundable. Where In2Frame is able to offer a transfer, alternative date or credit, this will be considered on a case-by-case basis and is not guaranteed.

Private sessions

For private lessons, choreography sessions or rehearsals, cancellations should be made as early as possible. Unless a different cancellation period has been agreed in writing:

  • Cancellations made more than 48 hours before the session may be rescheduled or refunded, subject to any non-refundable costs already incurred.
  • Cancellations made within 48 hours may be charged in full.
  • Failure to attend without notice ("no-show") may be charged in full.

Filming and creative projects

For filming, showreels and bespoke creative projects, cancellation arrangements may differ depending on the amount of preparation and expenditure involved. If you cancel after In2Frame has incurred costs on your behalf, including studio hire, equipment hire, crew, travel, preparation or other third-party costs, those costs may be deducted from any refund due. Any bespoke cancellation arrangements agreed with the Client will take priority.

6. Cancellations by In2Frame

In2Frame reserves the right to cancel, postpone or reschedule a session or project where reasonably necessary. Reasons may include:

  • Illness
  • Staff or instructor unavailability
  • Venue problems
  • Equipment failure
  • Severe weather
  • Health and safety concerns
  • Events outside our reasonable control
  • Insufficient bookings for a particular session.

Where In2Frame cancels a service and cannot provide a suitable alternative, the Client will normally be offered a rescheduled date, credit or refund for the affected service, as appropriate.

Nothing in these Terms affects your statutory rights.

7. Refunds

Refunds will be considered in accordance with these Terms and applicable UK consumer law. Where a refund is approved, it will normally be made using the original payment method.

In2Frame will not normally provide refunds for:

  • Classes or sessions that a participant chooses not to attend;
  • Late cancellations where the cancellation fee applies;
  • No-shows;
  • Work that has already been completed and delivered in accordance with the agreed service;
  • Costs that have already been incurred specifically on the Client's behalf, where those costs are non-refundable.

These exclusions do not affect any legal right the Client may have to cancel or receive a refund.

8. Consumer Cancellation Rights

Where UK consumer cancellation laws apply, Clients may have a legal right to cancel certain services within a statutory cancellation period.

There are exceptions, including circumstances where a service is fully performed within the cancellation period with the Client's express request and acknowledgement that the right to cancel may be lost. For bespoke or time-specific services, different legal rules may also apply.

Nothing in these Terms is intended to remove or restrict any consumer rights that cannot legally be excluded.

9. Participation in Dance and Physical Activities

Dance and choreography involve physical movement and carry an inherent risk of injury. Participants are expected to:

  • Follow reasonable instructions from In2Frame staff.
  • Participate within their own physical abilities.
  • Inform the instructor of any relevant injury, limitation or condition that may affect safe participation.
  • Stop participating if they feel unwell, injured, dizzy or otherwise unable to continue safely.
  • Behave respectfully towards instructors and other participants.

Participants should not take part if they are unwell or injured to the extent that participation could reasonably put themselves or others at risk.

In2Frame reserves the right to ask a participant to stop an activity where we reasonably believe continued participation would be unsafe.

10. Medical and Emergency Situations

Participants, or their parent/guardian where the participant is under 18, are responsible for providing accurate information that is reasonably necessary to enable safe participation.

In an emergency, In2Frame may contact the emergency services and, where appropriate, the participant's emergency contact.

Parents/guardians of participants under 18 should provide current emergency contact details.

11. Behaviour and Conduct

All participants and Clients are expected to behave respectfully towards:

  • In2Frame staff
  • Choreographers
  • Teachers
  • Videographers
  • Other participants
  • Venue staff
  • Members of the public.

In2Frame does not tolerate:

  • Bullying
  • Harassment
  • Discrimination
  • Abusive or threatening behaviour
  • Sexual harassment
  • Deliberate disruption
  • Intimidation
  • Damage to property
  • Inappropriate or unsafe behaviour.

In2Frame may refuse participation or terminate a booking where behaviour presents a genuine risk to other people, staff, property or the safe operation of the activity.

12. Children and Young People

Where a participant is under 18, a parent or legal guardian must provide any required consent before participation. This may include:

  • Consent to participate;
  • Emergency contact information;
  • Relevant medical or access information;
  • Photography and filming consent;
  • Consent for social media or promotional use where applicable.

In2Frame's Safeguarding & Child Protection Policy applies to activities involving children and young people. Parents and guardians are expected to familiarise themselves with the relevant safeguarding arrangements.

13. Photography and Filming

In2Frame may provide photography and filming as part of its services.

Where participants are filmed or photographed for showreels, promotional material or social media, the appropriate consent will be obtained. For participants under 18, parental/legal guardian consent will be obtained where required.

Filming consent is separate from consent to participate in a dance class or other activity where appropriate. A participant may decline optional promotional filming without being disadvantaged in their participation in the underlying service.

14. Use of Creative Content

Unless otherwise agreed in writing, In2Frame retains ownership of its original creative work, including:

  • Original choreography created by In2Frame;
  • Creative concepts;
  • Editing techniques;
  • Branding;
  • Templates;
  • Production methods;
  • Unused footage and working files.

The Client will receive the agreed final deliverables specified at the time of booking.

The Client may use the final deliverables for the agreed personal, portfolio or promotional purposes, subject to any restrictions communicated by In2Frame.

The Client must not commercially reproduce, resell, license or substantially modify In2Frame's original creative work without prior written permission where such permission is required.

15. Client-Supplied Material

Where the Client supplies music, photographs, logos, video footage or other material, the Client is responsible for ensuring that they have the necessary rights or permissions to use that material.

The Client agrees not to provide material that they do not have permission to use.

The Client agrees to indemnify In2Frame against reasonable claims arising from the Client's unauthorised use of third-party material, to the extent permitted by law.

16. Music and Copyright

Clients are responsible for obtaining any permissions required for music or other copyrighted material that they supply or request In2Frame to use.

Where content is intended for social media platforms, the Client acknowledges that platforms such as Instagram, TikTok and YouTube may restrict, mute, remove or otherwise limit content because of copyright or platform rules.

In2Frame cannot guarantee that content will remain available on a third-party platform.

17. Delivery of Creative Projects

For bespoke filming, showreel or editing projects, In2Frame will aim to deliver the agreed final content within the timeframe communicated to the Client.

Delivery times may change where:

  • The Client delays providing information, materials or feedback;
  • Third-party services are delayed;
  • Technical problems occur;
  • Events outside In2Frame's reasonable control occur.

Where revisions are included, the number of included revisions will be agreed before work begins. Additional revisions may incur an additional charge.

18. Client Approval

Where the Client is given an opportunity to review a draft, the Client is responsible for providing feedback within the agreed timeframe.

Once the Client has approved a final version, further changes may incur additional charges.

19. Equipment and Personal Property

Participants are responsible for their own personal belongings.

In2Frame is not responsible for loss, theft or damage to personal property except where liability cannot legally be excluded.

Participants should avoid bringing valuable or unnecessary items to sessions.

20. Liability

In2Frame will take reasonable steps to provide its services safely and professionally.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Subject to the above, In2Frame will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.

Participants remain responsible for participating within their own abilities and following reasonable safety instructions.

21. Venues

Where activities take place at a third-party venue, participants must comply with the venue's reasonable rules and safety requirements.

In2Frame is not responsible for matters outside its reasonable control relating to third-party premises.

22. Events Outside Our Control

In2Frame will not be liable for failure or delay caused by circumstances outside its reasonable control. This may include:

  • Severe weather;
  • Natural disasters;
  • Government restrictions;
  • Public emergencies;
  • Venue closure;
  • Major transport disruption;
  • Serious illness;
  • Power or internet failures;
  • Equipment failures;
  • Third-party service failures;
  • Other circumstances that could not reasonably have been prevented.

Where possible, In2Frame will provide an alternative date, solution or other appropriate remedy.

23. Privacy and Personal Information

In2Frame will collect and use personal information only as reasonably necessary to provide its services, manage bookings, communicate with Clients and meet its legal obligations.

Personal information will be handled in accordance with In2Frame's Privacy Policy.

Where appropriate, additional consent will be obtained for photography, filming and promotional use.

24. Changes to These Terms

In2Frame may update these Terms from time to time.

The version applicable to a booking will normally be the version provided or made available to the Client at the time of booking.

Material changes will be communicated where appropriate.

25. Complaints

We want Clients and participants to have a positive experience. If you have a concern or complaint, please contact:

Email: in2frame654@yahoo.com

We will aim to acknowledge complaints promptly and investigate them fairly.

Where a complaint concerns safeguarding, it will be handled in accordance with our Safeguarding & Child Protection Policy.

26. Governing Law

These Terms are governed by the laws of England and Wales.

Nothing in these Terms affects any statutory consumer rights available to you.

27. Acceptance

By booking or participating in an In2Frame service, you confirm that:

  • You have read and understood these Terms & Conditions;
  • The information you have provided is accurate;
  • You agree to comply with these Terms;
  • Where applicable, you are authorised to agree to these Terms on behalf of a participant under 18.
